1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and YAS - You Are Salon ("YAS," "we," "us," or "our") concerning your access to and use of our mobile application and website (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

3.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice.

4. Use of the Platform

4.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use.

4.2 Prohibited Activities

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Platform or related systems
• Interfere with or disrupt the Platform's operation
• Impersonate any person or entity
• Collect or harvest information from other users
• Use automated systems (bots, scrapers) without our permission
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users or service providers

5. Bookings and Appointments

5.1 Booking Services

The Platform allows you to book appointments with independent beauty and wellness service providers ("Service Providers"). YAS acts as an intermediary platform and is not the provider of the beauty or wellness services.

5.2 Service Provider Relationship

Service Providers are independent contractors, not employees or agents of YAS. The service agreement is directly between you and the Service Provider. YAS is not responsible for the quality, safety, or legality of services provided.

5.3 Cancellation and Refunds

Cancellation and refund policies are set by individual Service Providers and will be displayed at the time of booking. You agree to abide by the applicable cancellation policy. Late cancellations or no-shows may result in charges as specified by the Service Provider.

6. Payments and Fees

6.1 Pricing

Service prices are set by Service Providers and displayed on the Platform. Prices may be subject to change. You agree to pay all charges incurred under your account, including applicable taxes and fees.

6.2 Payment Processing

Payments are processed through third-party payment processors. You must provide valid payment information. You authorize us to charge your payment method for all fees incurred.

6.3 Service Fees

YAS may charge service fees, booking fees, or other charges as disclosed at the time of booking. All fees are non-refundable unless otherwise stated.

7. User Content and Reviews

7.1 User Content

You may submit reviews, ratings, photos, and other content ("User Content"). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with the Platform.

7.2 Content Standards

Your User Content must not be illegal, offensive, defamatory, fraudulent, or violate any third-party rights. We reserve the right to remove any User Content that violates these Terms.

8. Intellectual Property

The Platform and its content (excluding User Content) are owned by YAS and protected by intellectual property laws. Our trademarks, logos, and brand features may not be used without our prior written permission.

9. Disclaimers and Limitations

9.1 Platform Availability

The Platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation of the Platform.

9.2 Service Provider Disclaimer

YAS does not warrant or guarantee the quality, safety, or legality of services provided by Service Providers. We do not conduct background checks on all Service Providers, though we encourage professional verification.

9.3 Limitation of Liability

To the maximum extent permitted by law, YAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless YAS, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

11.2 Informal Resolution

In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting us at support@yas.app.

11.3 Arbitration

If informal resolution is unsuccessful, any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YAS regarding the Platform and supersede all prior agreements and understandings.
